This contract is entered into between Darlene McCarthy (Desert Daze Cockers) hereinafter known as seller and
Hereinafter known as buyer.
BUYER AND SELLER AGREE TO THE FOLLOWING PROVISIONS OF THE SALE
Seller makes the following assertions at the time of buyer taking possession of the puppy:
1) This puppy is the offspring of AKC registered parents. The pedigree is correct and a copy has been given to buyer
at the time of sale. The puppy can be registered with the AKC (American Kennel Club) on FULL OR LIMITEED terms as indicated.
If the puppy is sold on limited registration, the puppy must be neutered or spayed by 6 months of age.
2) This puppy, to the best of the seller's knowledge, is in sound health on the date of sale, and has had vaccination(s)/worming
required for its age at the time of this agreement.
3) The buyer has the option to have the puppy examined by a licensed veterinarian within 7 day's of receiving the puppy.
If the puppy is determined to be unfit for sale, as evidenced by a veterinarian's statement, buyer can elect to keep the puppy,
assuming all costs for its care, or may return the puppy for a full refund upon seller's receipt of the veterinarian's statement
regarding the puppy's health, and return of the puppy and all important papers. This provision will expire 7 day's after
buyer takes possession of the puppy.
While I do my best to make sure my pups are free from parasite's, such as worms, coccidian, mites, ticks and flea's.
I do not include these under my guarantee, as they are common, and can be picked up at any house with other pets, park, groomer's
vet etc. and are easily treated.
No money will be refunded, for any reason, after this guarantee expires.
The seller guarantees this puppy for twelve months from date of sale, against most defects that is genetic in its nature
(except those listed below). If a genetic defect arises within the first twelve months that limits the dog's ability to lead
a normal life as a family pet, we will replace the puppy with a puppy of equal value-- within 12 months of the vets diagnosis
(in writing) being sent to the breeder. The seller has the option of getting a second opinion from a vet of her choice, and
at her expense. If a replacement pup is not available within 12 months, the original purchase price will be refunded.
The puppy will NOT be guaranteed for cherry eye, retained testicle, allergies (human or canine), retained baby teeth,
and umbilical hernias. The seller DOES NOT guarantee against any environmental temperament problems, more specifically, abuse,
neglect, teasing, or failing to provide appropriate training and socialization.
The seller assumes no responsibility for any disorder acquired by the dog through injury, nutritional, or anything of
an infectious nature during the lifetime of this dog.
We represent our puppies as being suitable as pets only. We make no claim that they are suited as breeding or show animals
and we offer no compensation for circumstances or characteristics that limit the dog's ability to be bred or competitively
shown.
This puppy has been started on preventative health care. She/he had received the 1st in a series of puppy vaccinations
and worming needed to begin a healthy life.
Buyer is responsible for continued vaccinations. FAILURE TO CONTINUE WITH VACCINATION SCHEDULE AND OR ROUTINE MEDICAL
CARE WILL VOID THIS AGREEMENT.
Should the buyer decide for any reason that they cannot keep the puppy; the buyer agrees to re-home the dog in a suitable
home or ask the breeder for assistance in doing so. Buyer agrees that under no circumstances will they ever place the puppy
with a puppy mill, animal shelter or research facility.
At no time after the sale of this puppy, will the seller be held responsible for any vet fees. Nor will the seller be
held responsible for any transportation costs if the pup is returned to seller for any reason, or at any time in the puppy's
lifetime.
By signing this receipt and taking possession of said puppy, the buyer understands, and agrees to the conditions stated
above. This contract represents final and all guarantees, agreements, and terms of the sale of this puppy between seller
and buyer. Also, this agreement is made and entered into in the province of British Columbia, and shall be enforced and interpreted
under the laws of the province.
